BLUTOURS Terms and Conditions
Before booking, you are required to read the following terms and conditions.
Your booking for one of the packages constitutes a contract by which you accept each and every one of the terms and conditions set out in this brochure, including limitation of liability.
All prices include (unless otherwise stated)
· Round-trip economy airfare from Montreal (if included in itineraries and inclusions)
· Transfers between the airport and the hotels
· Airport taxes
· Transportation by coach, train or boat (if mentioned in the itineraries and inclusions)
· Accommodation in double occupancy with bathroom. Individual rooms are limited and will be confirmed after booking
· Meals mentioned in the itineraries (beverages not included unless otherwise stated in the programs)
· Visits (if mentioned in itineraries and inclusions)
· Handling of a bag per person (unless otherwise stated in the programs)
Passport fees / Insurances / Excursions / Personal expenses / Gratuities / visa fees if applicable / Airport taxes at destination (if applicable)
How to book
Travel Agent Statements: Prior to booking, you must clearly explain to your travel agent your requirements, tastes, needs and expectations for the proposed trip, as well as any particulars that may affect the validity of travel tickets and the smooth running of your package (for example, whether you are a national of a country other than Canada, you have a disability, etc.) so that your travel agent can advise you adequately. The name given at the time of booking must be that in your passport.
A deposit of $ 500 per person will be payable at the time of booking. This deposit may vary depending on the type of trip. This deposit does not include insurance. Final payment is due 60 days prior to departure. In the case of cruises, it is due 90 days before departure. The amount of security deposit per person, subject to change, may vary depending on certain cruises / routes (including holidays), depending on promotional rates, group rates and flight / cruise programs. Notwithstanding the foregoing, BLUTOURS reserves the right to establish different terms of payment in connection with the specific promotion of certain of its services, including, but not limited to, the payment requirement in full at the time of booking.
Allocation of rooms and cabins
Only hoteliers and cruise lines are responsible for the allocation of rooms or cabins according to the reserved category. Specific requests for bed types, room or cabin equipment and the location of the room or cabin can be forwarded to the hotelier or cruise line. These requests are in no way a confirmation.
Payment by credit card
In the case of payment by credit card, the signature of the cardholder is compulsory and the travel agent must retain proof of this. BLUTOURS reserves the right to cancel any reservation in case the signature of the holder does not appear on the payment form of the credit card. In the case of reservations made by telephone, the consumer, by allowing the use of his credit card number by the travel agent, undertakes to respect the booking conditions even if he has not signed the and agrees to sign the payment form upon request, failing which the reservation will be canceled and subject to the penalties set out under “Cancellation Fees”.
All prices for the indicated packages are based on two adults sharing a room. They must be read in Canadian dollars. Promotional prices shown are valid if paid by check or money. The regular prices shown are valid if paid by credit card. If, afterwards, the same package is found to be reduced, BLUTOURS reserves the right not to apply the reduction on reservations already under deposit.
We strongly advise you to insure against risks generally associated with travel abroad: cancellation fees, medical and hospitalization expenses, loss of luggage, etc. Your travel agent can advise you on this.
BLUTOURS will charge a cancellation fee in all cases of cancellation of a booking at the request of a traveler, for whatever reason, including the occurrence and / or apprehension of political disturbances, acts terrorism, natural disaster, personal reasons, etc. The following cancellation fees are therefore applicable for any cancellation before departure (per person):
– more than 60 days: $ 500
– 60 to 31 days: 50% of the cost of the package
– 30 to 22 days: 75% of the cost of the package
– 21 days and less: 100% of the cost of the package
Excursions (if purchased and paid before departure from Canada): 10% of the total cost if canceled before the documents are issued; after issuance, 100% of the total cost.
River cruises: (cruise only)
More than 121 days before departure: loss of deposit
120-90 days before departure: $ 400 USD per person
89-60 days before departure: 35% of the land portion and cruise
59-30 days before departure: 50% of the land portion and cruise
29-7 days before departure: 80% of the land portion and cruise
6 days or less before departure: 100% of the land portion and cruise
In case of cancellation you must send us all the documents in order to receive the refund if necessary. To determine the cancellation period, the day of departure will be excluded. If the cancellation of one or more passengers changes the occupancy basis of the room (s) for the passenger (s) still traveling, the last passenger (s) will have to disburse the amount of the difference incurred by such changes. In all cases where a passenger wishes to modify, change or cancel his / her package, he must send a written notice to BLUTOURS, within the prescribed time. No refunds will be made by BLUTOURS for canceled or unused services after the passenger has left Canada.
Change of reservation
If your reservation is confirmed by BLUTOURS, you wish to change the arrangements already made, any changes (dates, flights, destination or name spelling) will be subject to availability and a $ 100 per person charge will apply .
Increased costs and other changes
A) MODIFICATIONS BEFORE BOOKING: This brochure has been printed several weeks before the date of the first departure described and BLUTOURS reserves the right to make changes without notice to destinations, prices, hotels and services. Consult your travel agent for exact details of each package before making your reservations. The quoted prices are based on the costs fixed at the time of printing. They are based on fuel costs, exchange rates, and a number of other factors. In the event of an increase in these costs, BLUTOURS reserves the right to increase the price of any of these packages without prior notice.
B) MODIFICATIONS TO YOUR PACKAGE AFTER YOUR RESERVATIONS: The prices of each package are based on the costs fixed at the time of your reservation. In the event of an increase in these costs after your reservation, BLUTOURS reserves the right to claim an additional amount that you must pay before your departure unless you choose to notify us in writing within three (3) days of the notice, of your decision to cancel your reservations, in which case BLUTOURS will reimburse you the amounts your travel agent has paid us for your package without any other obligation.
C) OTHER CHANGES AND CANCELLATION: In certain exceptional cases, BLUTOURS may proceed and reserves the right to make changes to your package. Some of these changes are minor (eg change of carrier, change of hotel for a similar category, change of route, etc.) and will not affect the enjoyment of your holiday. In case of cancellation of your package by BLUTOURS, or of major modification, we will communicate with YOU in order to offer you a new package of comparable quality that you will have the leisure to accept, or failing that you will be able to obtain a refund. You must notify us in writing of your decision within 72 hours of such notice. After your arrival at destination, in the event that a service of your package can not be provided, we reserve the right to replace the said service with another one of comparable or superior quality. AFTER THE END OF THE PRICE VALIDITY PERIOD and in the event of an increase in our prices, BLUTOURS undertakes to notify the customer within a reasonable period of time. If the proposed increase is 5% higher than the price published in this brochure (before airport taxes), the customer may choose to accept this increase, whether he agrees to pay with his final payment or to refuse it . In the latter case, BLUTOURS undertakes to reimburse without penalty any amount received on deposit from the customer without further compensation. Reimbursement of airport taxes only upon receipt of original ticket. IN ALL CASES BLUTOURS ‘liability is strictly limited to reimbursement of the amounts you have paid in connection with your package, without recourse for damages or otherwise. BLUTOURS reserves the right to cancel a package due to lack of participants.
Costs not included in the package
Each detailed itinerary gives the services included in each of our packages. Personal expenses (meals, wine or alcohol, optional excursions) and any other expenses not specifically stipulated as part of the package must be paid by passenger. Departure taxes for the chosen destination, passport fees and tips are not included in the package price.
Some countries require passports to be valid for at least 6 (six) months after the date of return to Canada. All passengers must ensure that they have a valid passport according to the requirements of the countries visited. Travelers with a non-Canadian passport may require other documents (eg visa or vaccination certificates). These must be obtained by the traveler prior to departure from Canada. It is your responsibility to find out from the relevant authorities about this. In the event of a default by the traveler, the traveler may be refouled by the carrier and / or the authorities of the country without being entitled to any reimbursement from BLUTOURS.
Medical recommendations and invalid travelers:
Some circuits can be tiring for the elderly or for people who are not healthy or have a disability. Due to heat in some areas, frequent travel and food changes, we recommend that you leave Canada healthy and rested. Unfortunately, as part of its regular programs, BLUTOURS does not provide special care or special assistance to people with disabilities. In addition, some hotels are not equipped to offer special care to persons with disabilities or disabilities, and as a result, travel is not recommended. Any person suffering from disability or incapacity and requiring special attention or treatment must notify BLUTOURS in writing at the time of booking and submit a declaration signed by his / her physician to the effect that he / she is fit to participate in the circuit and can move without the assistance of another member of the group. BLUTOURS reserves the right to refuse a passenger who can not complete the journey, or for whom the trip could constitute a danger to himself or others.
Some drugs are not available abroad. You must bring with you a sufficient quantity of all medications that you must take, either by prescription, or otherwise. Also, make sure your medications are in your carry-on baggage; NEVER leave them in a luggage compartment and NEVER give them to others.
Declaration to the travel agent: the client must inform his travel agent of his intentions, expectations and needs regarding the planned trip before the booking is made. State of health: the client whose health requires it must provide a sufficient quantity of all the medicines that he may need and must always carry them in his hand luggage. Before departure, the client must also inform the competent medical authorities of all preventive medical measures to be taken according to the country or countries visited.
Cruise companies do not accept passengers who have reached their twenty-fourth (24th) week of pregnancy before the end of their cruise. A medical certificate stating the expected date of delivery and the passenger’s capacity to travel is required. An air carrier may refuse a pregnant passenger for whom travel may present a risk to itself or the unborn child. Please consult your travel agent for more information on air carrier policies in this regard.
Air travel regulations allow for different baggage allowances per person depending on the airline used. PRAYER to inform you of the rules with your travel agent. The maximum dimensions may also vary from one airline to another. The total weight of the baggage must not exceed (according to the airline) 20 kilos (44 pounds). However, as space is restricted on coaches, you will be limited to one suitcase per person if you are traveling on tours. BLUTOURS declines all responsibility for the loss and / or damage of your luggage, whatever the cause.
AIR, MARITIME OR TERRESTRIAL TRANSPORT:
BLUTOURS has no control or obligation with regard to schedules, air, sea or land route, or type of aircraft, ship or vehicle, which are determined exclusively by the carriers concerned and are subject to change without notice. The air transport is done in economy class by the carrier indicated by BLUTOURS. Conditions of carriage are subject to the terms and conditions of the transportation ticket and government regulations.
Our air contracts do not allow us to make selections at any time. We can communicate your preferences to regular airlines, without any guarantee of confirmation of a seat number. We advise you to arrive, at least 3 hours in advance at the airport and to choose your seat yourself when checking in at the counter. The liability of any air carrier in the event of loss, theft or damage to baggage as well as in the event of damage to the property or the person is limited by the terms and conditions set out in the contract on the passenger ticket. Tickets or boarding passes are non-transferable and non-negotiable. Places in means of transport are assigned exclusively by the carrier, and BLUTOURS can not in any way guarantee a special place. In the case of air travel, YOU MUST present you at the check-in counter at the airport at least THREE HOURS before the scheduled time of departure, otherwise you may lose your reservations and seats may be assigned to other travelers, without recourse against BLUTOURS. In addition to the general conditions described above, the following provisions apply in all cases of tourist tours abroad.
· Operators of the circuits: The circuits abroad are not operated nor directed by BLUTOURS but by local operators and / or suppliers whose names appear on your vouchers. The role of BLUTOURS is strictly limited to transmitting your reservations to the local operator and BLUTOURS assumes no responsibility in the event of fault, error or non-performance by these operators or their representatives on site.
· Route changes: The itineraries of the circuits described in this brochure are for information purposes only and are subject to change at any time. The cities or stages, described at the circuits, taken individually or together, can under no circumstances be considered as determining criterion to your reservation. Routes, visits, accommodations or modes of transport are subject to change during the tour, due to special circumstances and the local operator and the guide are at liberty to decide at any time to make changes or such a decision being final and without recourse.
Tour Leaders, Disc Jockey, employees, etc., are mandated by the group, discotheque or organization that booked the trip

Correspondents and local guides
The tours and visits mentioned in the itineraries are carried out by local guides. For most visits, BLUTOURS provides local French-speaking guides, but it should be understood that the accents may vary from one country to another. Inbound and outbound transfers are made by drivers (not necessarily speaking French) and do not necessarily include the services of local guides.
Hotels, rooms and cabins
The hotels presented in this brochure are rated according to the quality criteria specific to the country where they are located. The standards used to establish these criteria are sometimes lower than North American standards because they take into account the services available rather than the comfort offered in the rooms / cabins. Hotels are subject to availability at the time of booking and may be replaced by others of similar category. The rooms / cabins are distributed by the hoteliers / shipping companies, according to the availabilities at the time of the arrival of the passengers. BLUTOURS has no control over the dimensions, location or view of rooms / cabins allocated to passengers. It is possible to book a cabin with sea view or balcony for an additional charge.
Single rooms: The single rooms, outside of North America, are generally smaller and less well located in hotels than double rooms. Their number is very limited and they will be confirmed only after reservation.
Room sharing requests: Participants who have booked a single occupancy package may ask to share their room with another participant at the time of booking. All requests for room sharing must be made in writing at the time of booking. BLUTOURS will try to accommodate those who request it, but BLUTOURS makes no commitment as to the fate of such requests, the compatibility of the participants gathered or the quality of the agreement between them, the latter assuming alone, to the complete exemption of BLUTOURS, all the risks and inconveniences associated with sharing a room with a foreigner, including the risk of not being able to change a traveling companion, the impossibility of obtaining a separate room during the trip or to pay an additional fee to change room occupancy during travel, which is not always possible. In the event that a request for room sharing is refused or if no such request is made, a requesting participant may not invoke this reason to cancel his / her reservations and must pay the supplement of a ” single occupancy.
During his stay abroad, the passenger undertakes to accept and respect any reasonable instructions relative to the package, issued by BLUTOURS or its representatives. Anyone whose behavior is detrimental to the enjoyment of the other participants or who refuses to follow the instructions of the representatives of BLUTOURS may be obliged to return to Canada before the end of the trip at his expense.
Interpretation and jurisdiction
This Agreement shall be construed in accordance with the laws of the Province of Quebec. In all cases where the point of departure is in the province of Quebec, the parties elect domicile in the judicial district of Montreal. The invalidity of any clause of this contract in whole or in part shall not affect the validity of the other clauses.
Limitation of Liability
Without limiting the generality of the foregoing, BLUTOURS shall not be liable for any claims for loss, damage, delay, illness, injury, inconvenience, loss of use, anxiety, arising out of: a) fault, negligence or omission of the tourism providers, carriers, hoteliers, etc .; (b) illness, theft, strike, mechanical failure, quarantine, governmental constraints, weather or any other cause beyond its control; (c) the passenger’s failure to bring and / or obtain the required travel documents; (d) any delay by the passenger at the airport for any reason on the day of departure; (e) delay or delay of an air, sea or land carrier; (f) property damage, loss of property and theft; (g) personal injury, sickness or death for whatever reason, including tropical diseases, food poisoning, accidents during transport, fire, etc. BLUTOURS does not act as insurer for the risks of a trip. The calculation of the cost of our packages takes into account the fact that you consent to the limiting liability clauses written in favor of BLUTOURS. The price of our packages would be much higher in the absence of such clauses.
VACANCES BLUTOURS assumes no responsibility for any failure to perform its obligations, including but not limited to any loss or damage resulting from delay, cancellation, adverse weather conditions, loss personal property, illness, injury, accident, mortality, deterioration in the quality of services, inconvenience, loss of use, disappointment or frustration of a physical or mental nature resulting from the following events:
· Unforeseeable circumstances, superior forces or a third party;
· War, revolution, insurrection, riot, embargo, terrorism or terrorist act or any other unlawful act against public order or the authorities;
· Fire, flood, explosion, earthquake, epidemic, pandemic, quarantine, public health emergency, storm, lightning, hurricane, tornado, volcanic eruption or tsunami;
· Accident or failure of an aircraft or related equipment, loss or misuse of aircraft, or lack of labor, fuel or equipment or inability to obtain such equipment;
· A strike, lockout, labor dispute or other labor relations issue involving the employees of BLUTOURS, its service providers or any other entity with which BLUTOURS does business;
· Governmental order, regulation, action, inaction, or failure to obtain the approval of a governmental authority having jurisdiction in the circumstances and which may be required for the conduct of the transactions herein or any other legal or governmental restrictions applying thereto;
· Other entities with which BLUTOURS does business in order to offer the services provided herein in whole or in part;
· Any other factors beyond the reasonable control of BLUTOURS and any other event that can not reasonably be anticipated, anticipated, or predicted to be real, threatening to occur or reported, and which could affect the operations of BLUTOURS or its service providers.
BLUTOURS and the airlines and service providers assume no liability arising from unauthorized statements, actions, misrepresentations or misrepresentations regarding the standard, quality, services provided or benefits included or excluded in the holiday programs described . It is essential that you notify us of any complaints as quickly as possible. We ask that you send us the details of your complaint or complaint in writing within fourteen (14) days of the date of your return.
